1. Acceptance of Terms

By accessing and using the ShortNow platform ("Service"), provided by ShortNow LLC ("Company", "we", "us", or "our"), located in Wyoming, United States, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ShortNow provides a cloud-based communication platform that enables businesses to send and receive SMS messages, voice broadcasts, and manage marketing campaigns via our web interface and API.

3. User Responsibilities & Compliance

You are solely responsible for all content transmitted through your account. You agree to use the Service in compliance with all applicable local, state, national, and international laws, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and the California Consumer Privacy Act (CCPA).

You explicitly agree NOT to:

• Send unsolicited messages (spam) to recipients who have not provided explicit opt-in consent.
• Transmit any material that is unlawful, harassing, defamatory, abusive, threatening, harmful, or otherwise objectionable.
• Use the Service for phishing, identity theft, or distributing malware.
• Spoof caller IDs or attempt to mislead recipients regarding the origin of the message.

4. Account Security

You are responsible for maintaining the confidentiality of your account credentials and API keys. ShortNow LLC is not liable for any loss or damage arising from your failure to protect your login information.

5. Billing and Payments

The Service is billed on a prepaid basis or according to the specific enterprise agreement in place. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. Refunds are provided solely at our discretion and in accordance with our Refund Policy.

6. Service Availability & SLAs

While we strive for 99.9% uptime, ShortNow does not guarantee uninterrupted service. We are not liable for delivery failures caused by downstream carrier networks, invalid recipient numbers, or factors outside our direct control.

7. Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Service or our Acceptable Use Policy.

8. Limitation of Liability

In no event shall ShortNow LLC, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
